公權力濫用使民眾無法正常工作與生活

板橋市民遭公權力濫用侵權，以致無法在社會上工作與正常生活情形，依時間順序摘要記述：
Due Process:
兩名新北市刑警到板橋住家逮捕(2011/12/29)，並在刑事傳票傳喚下至台灣板橋地方法院出庭(libel case, criminal investigating court, 2012/1/30, 2012/4/2)迄今5/29已屆滿五個月：

1.在6年(36個月)之前，在2005年11月台北縣警局(新北市警局前身)的兩名警察，在國安局以能量騷擾掩護下，至板橋國民黨民眾服務社旁的麥當勞速食店驅離顧客與當事人David Chang；同時期也在星巴克咖啡對顧客David Chang進行同性質的警事騷擾。

在2011/12/29至David Chang板橋住家，進行威嚇性逮捕的兩名新北市刑警大隊刑警官，其中一名刑警據悉已考取國家高等考試司法檢察官資格，但未有開庭紀錄，該刑警在2002年或2004年曾遭某女性受害人以當事人David Chang隔鄰之板橋社區為案件現場進行告訴強暴案，當時該刑警以女性受害人不知其警察身份原因操作法律調查與偵查程序，取巧以受害者指認錯誤為名目而規避法律制裁。另外又在2004年7月邱淑貞死亡案發後進入社區管制區調查後，與當事人David Chang在社區後方隔著陽台直接照面後(2005年夏天)，該刑警於社區內開口詢問社區住戶與建商，得知隔鄰登錄為紐約市大輟學生的David Chang為當時台北縣警局(新北市警局前身)副局長戴耀聰之妻何照室的表弟，因社區建商住戶隔著陽台與當事人David Chang交談內容中，懷疑社區隔鄰的當事人David Chang知悉遭告訴的社區內強暴案，在照面後約半年之內於2005年11月立法委員補選之前，藉機以國安局微軟電郵帳戶盜用案(identity theft, hotmail account, November 2001, 當事人David Chang於官股華南銀行之資訊室註冊帳戶與國安局數名幹員於機房操作盜用，多名涉案國安幹員以張麗娟幹員為代表，涉案人多人並以法律操作不在場證明，進行規避法律程序的證人指認, that is, organizational conduct of misleading law court)，在2005年11月因微軟電郵帳戶盜用涉案的湮滅證據與偽證需求，民進黨籍數名國安局幹員於陽明山機房值勤時，觀察與進行騷擾麥當勞餐廳用餐的當事人David Chang，另一方面在國安局的能量騷擾掩護下，涉案的台北縣警員於國民黨板橋民眾服務社旁的麥當勞速食店，與當事人David Chang拉扯出之麥當勞，這件事因為發生在美國企業麥當勞速食店，遭美國某紐約抵台FBI幹員通知紐約市大輟學生與當事者David Chang留意(據悉身份為紐約聯邦調查局女性幹員，當時在板橋社區附近或在社區內，美方一度曾要求當事人David Chang網路撰文指責涉案警察行為，但當時未獲當事人David Chang首肯。)

2.在13個月之前，於2010年9月到內湖某科技公司找工作，筆試與面試，但先前在國家圖書館因撰寫民權案文件遭長期能量與館內人員騷擾，有與連續警察衝突事件，當時透過104人力銀行仲介的雇主推測因此不敢雇用，或是以政府騷擾至精神科為由，進行歧視而拒絕雇用。

3.在8個月之前，於2011年3月31日，台灣大學法律系陳淑麗檢察官(在1995年6月,就讀台大法律系一年級，升二年級前暑假簽立國防部合約，畢業後考取為司法院檢察官)，以美國聯邦調查局簽約屆十年須進行訓練為由，從司法院檢察官職改調法務部調查官，在當事人於住家對面太陽神網咖上線時跟監，同時在2011年3月的魔獸世界職業選手季總決賽，拿走前三名所有獎金約新台幣27萬元，與魔獸世界職業選手衝突，當時法務部陳淑麗調查官上線所用的角色附帶的「瘋人院」公會，因而被檢舉回報為騷擾玩家。

4.在7個月之前，於3月31日法務部調查局跟監之後，魔獸世界台灣的智凡迪公司以線上虛擬金幣遭盜為由要求下，在板橋實踐路7-Eleven超商於4月7日傳真寄回國民身份證。智凡迪公司處理時線上並有通知另外約三名玩家同時回報，另有留存於智凡迪公司內寄生之政府agent舉報檔案；但是第三方的線上訊息標示為美國總公司，通知這個茱麗角色的玩家David Chang遭盜情形明確並沒有問題，agent另外回報的檔案，「是台灣(政府或國安局)自己的事，與美國魔獸世界公司無關。」，並立即審核撥下虛擬金幣3000g，並將回報遭盜用的魔獸世界玩家帳戶改為正常狀態。

5.在5個月之前，於2011年6月或7月，當事人David Chang在智凡迪與警政署法律規範合作的魔獸世遊戲，另外又發生一起盜用騷擾事件回報，線上則回覆愛情海岸公會會長私下解決，並更改玩家為正常狀態，有機會成為操作偽證的法律漏洞。

6.在2個月之前，於2011年10月26日，美國國務卿希拉蕊‧柯林頓的生日當天早上，在台北市桂林路的家樂福量販店一樓新開設的麥當勞餐廳，除了台北市所屬的國安局特勤小隊以積攢些財務經費為名，線上提示某長官或名人說明觀察範圍內該當事人David Chang已經遭司法警事鎖定，不希望在美國政要希拉蕊‧柯林頓女士的生日，於麥當勞速食店留存給當事人David Chang有助益的麥當勞當天發票，因而在守門人(Gate keeper)角色放水，使當事人手上連續三張在該麥當勞桂林店的發票都是打印稅率的錯誤家樂福公司空白發票，或是金額錯誤的偽造發票，為對當事人的實質政府蓄意騷擾行為。在10月26日早餐時間，線上有美國國務院長官身份提示，告知麥當勞店內消費的當事人David Chang留意。

7.在2個月之前，於美國國務卿希拉蕊生日之後的10月27日早上10:30, 美東時間還在10月26日的晚上，國家圖書館內的駐警(牽涉1994年8月14日美國依娃‧愛弗麗台北死亡案，1995年4月至日本簽立外國軍事合約，據悉是美國的初階合約)，在國家圖書館的座位上，挑釁後將當事人David Chang的皮帶扯斷，掠倒在地上後驅離出館。該警員據悉曾在當事人David Chang的建國中學同學蘇明信遭撞死前，曾與國安局幹員張麗娟爭執對話，當時並且在國安聚會場合陳水扁演講前敲打總統當選人陳水扁的頭。

8.在2011年聖誕節後新北市刑警隊於12/29日至當事人David Chang住家逮捕，在1月19日簽發刑事傳票，橫跨農曆春節過年，於1月30日第一次偵查庭開庭；第二次刑事傳票傳喚4月2日偵查庭出庭。法律程序Due Process迄今5月29日已屆滿五個月。但是無故藉機警事逮捕與法庭偵訊審問，自1996年7月到8月之間當事人David Chang，因前美國第一夫人希拉蕊‧柯林頓女士為其父親Hugh Rodham的1992年5月台北死亡案不滿，(美國總統柯林頓的母親在1994年8月搭乘飛機抵達拉斯維加斯之後死亡)，以訊息出言告知對話的台灣的政府無主權,(其幕僚隨從或其本人,搭腔接話「台灣的政府無國格」)，並在1996年8月2日提前開學後於小布希先生隨從下蒞校，並與小時候1個月大與11個月大時就認識的當事人David Chang合照，在一週之內當事人的祖母張王密隨即在8月9日於台北榮總因醫療疏忽致死，台北的長官即國民黨主席與康乃爾大學校友李登輝在8月11日左右，重申國家國格遭侮辱(美國紐約當地有說當地派遣幹員聽錯並記錄錯誤，第一夫人是說無主權並非無國格)，「把小朋友弄回台北，(他祖母也死掉了，直接叫他回來啦！)」從1996年到2012年在18年之中，這些政府騷擾侵權行為，包括現在進行的警事與司法的程序(Due Process)，在某種程度上，看起來與張麗娟幹員或是其他國安局幹員的湮滅證據，偽證，誤導法庭偵查行為，實質上並沒有什麼不同。

Psychology Today June 2012 issue

Public occasion impromptu on health insurance topic of the soapbox preachers, a private jet passenger without 18-carat diamond-drop earrings, that was not whom you found in ordinary school days. However, you are in a summer vacation transporting something to the east continent of the dream land(Switzerland, Germany). Sunny sky, gentle weather, everything seemed so perfect. Then, a decade lapses, what happened at that time? How do you know? You know, therefore I know.

Recently I checked out several books from the New Taipei City Library using recently renewed library card, The Hunger Games, Harry Potter and the Order of the Phoenix, and this month with Stephen King's novel, Under the Dome. I have read a third of this dictionary alike, hardcover book. Hmm, living dictionary with 1074 pages. What I could say is that this is really a good book, teaches me a lot of things, since a decade ago when I first read his Different Seasons novel. When I was in my university days, borrowed a hard cover of Stephen King's novel but except for the first page the whole book left unread for that all check out period. This situation is improved quite a lot since I have this Psychology Today magazine subscription. To subscribe to the Psychology Today magazine is really, really helpful, and I mean it.

Up to this moment on May 23, I still have to deal with the aftermath of house intruding seizure from the New Taipei City Criminal Police on December 29 just after last Christmas, of a libel case on my Yahoo! website article accused by the Breeze Center owner Liao Cheng-han whom was obscured referred by the criminal police officers during the inquiring. There have already been two investigating courts held, due process as well has been endured lasting for the fifth month. Previously I had filed a malfeasance case against the prosecutor Lieu Dong-yun, but earlier was casually dismissed by the court prosecutor office with judicial arrogance, an arbitrary prosecutor office sealed letter scripted with two irrelevant law provisions inferred that my psychiatric NTU hospital record was queried in that very court and known, also without hiring any lawyer to defend a plea of innocence but paper works myself. The prosecutor accused in my filed malfeasance case, Mr Lieu Dong-yun was my acquaintance who had signed a CIA contract in October 1996, also contacted with the US First Lady Mrs Hillary Clinton to seek her backing and it was notified she granted him and his peers to fight with the US revenge listed international Taipei student and dropout student Mr David Chang, me, whose grandmother had just died of medical gross negligence at TVG(Taipei Veteran General) Hospital Taipei after the First Lady Hillary taken a picture with David on August 2, 1996 the City University of New York school open day. The dialogue alike message was delivered at the Newark airport before the airplane taking off in the midnight on October 22, 1996. I was pestered to leave the City University of New York Baruch Business School graduate program with my grandmother killed on TVG Hospital at Taipei City, message form the notification by the White House staff at city university classroom. It is recently notified that Prosecutor Lieu Dong-yun have just renewed his CIA contract before the first investigating court held on January 30.

Ch 40 Declaring- Bill Clinton, biography reading

Chapter 40, Declaring;

1. Before page 577 Chapter 40 of the 2003 Random House hardcover Bill Clinton biography, on page 575 titled Part Eight, Democratic Nomination, is a photo of (February 4, 1992) Star magazine's cover, with both Gov. Clinton and Singer Gennifer Flowers appeared on the cover. We can easily see that Clinton's head on the cover looked leaner and more slim than the pictures on page 519, Part Seven, The Sun King, Arkansas and on page 471, Part Five, Saying no to a presidential run, 1987. The face looks more like the November 1, 1990's "Daddy Long-Legs", when he seemed to get a replying word from me, a sophomore student of National Chiao Tung University(NCTU) at HsinChu City, Taiwan, as an Attorney General and Governor, but was described as a desperado alike character in Charles Dickens' novels David Copperfield and Great Expectations.

Fraud Busters 1:
On page 579 Bill Clinton's best friend (both Arkansas, of the same height, both earned law degrees), Jim Blair asked rhetorically, and said, "We're a close cousin of the primates..."
Actually the former Governor's daughter, the singer Gennifer Flowers had a cousin who was called by "Geannie" as boyfriend when she was trying to relate to the Governor. He was ordered to commit suicide at Taiwan around 1985.

Fraud Busters 2:
Educational background of Gennifer Flowers:
(1) BA and MBA, Chinese Culture University, 1990-1994
(2) MS in psychology, University of Texas, 1994-1996
(3) PhD in psychology, University of Arkansas, 1996-2001;
(meanwhile, also served as faculty, assistant professor in University of Arkansas)

2.Bill Clinton, An American Journey, Great Expectations, Chapter 40, Declaring, on page 585, "The Debris of a Broken Promise" Nigel Hamilton, as a historian wrote his pretext in this way, "The Arkansas Democrat would, in due course, have to eat its words, but the negative sentiment was widely echoed among those who liked Bill Clinton and/or Hillary--and especially among those who didn't."
Then the historian Nigel Hamilton's citing Meredith Oakley's words,
"His word is dirt."
(page 586) "The bleaters who care more for celebrity than veracity are basking in a false and empty light."
"They trumpet the basest form of political expediency, for they revel amid the debris of a broken promise."

Fraud Busters 1:
This section on page 585 is opposite to the section "Totally Crazy" on page 584, which is ended by journalist John Brummett's words, "But why would you want to? Your life will be ripped apart, you'll be so exposed!"

Fraud Busters 2:
"His word is dirt." The word "dirt" is slang for "money".
That could mean you as a privy have to pay money, not only to the author historian himself on the biography, but also to the law firm for lawyers when an implication occurs.

Fraud Busters 3:
The Star magazine cover, Feb. 4, 1992, was used for the pending 1980's Arkansas Law Court as a piece of plaintiff evidence, and was accepted by the law court against the Rose Law Firm skirted lawyers' defending. The historian author mentions in the biography of this paragraph could be a protesting in that very law court(1992), and to be a legal document recorded or filed properly in his history masterpiece.

Fraud Busters 4:
The questionable contents is the detail description of Bill Clinton's daily routine on page 584,
"Jogging downtown in his running shorts in Little Rock on the morning of October 3, 1991, 'Jell-O' Bill Clinton thought of the many times he'd nipped in to see Gennifer Flowers in the Quapaw Towers."
Actually, as a student of Chinese Culture University from 1990 though  1994, Gennifer Flowers would only show up at these places: Taipei, Tainan(Taiwan), and Texas, where in Texas because her Senator father assumed the post after leaving Arkansas. She would not be in Little Rock to be a perfect alibi. And the legal stance is further extended by the following sentence in Nigel Hamilton's Bill Clinton biography, "Although their sexual relationship had ended in 1989, they were still friends, and they still spoke intimately on the telephone." Therefore, what could be expected is "Totally Crazy" as the section title goes and hints on page 584.

My life became different since you came; Recently novel readings

This Monday I used my recently renewed New Taipei City Library Card to check out Stephen King's Nov. 2009 novel "Under the Dome" for 30 days to read the 1072 pages plus 2 pages of author brief. I have read 251 pages up to yesterday. 

Most impressive characters up to this 251 pages is the Town Kids called Rory Dinsmore. He took a ride of the ATV with handlebars to go around the hill several hundred yards from his father's farm house, with a double barreled 0.30 rifle with a box of grains from shelf called XPs reloaded. Sounds like Microsoft's Windows software product or IBM's Thinkpad series in the years. For general farmers and alike us ordinary students in those years, that may refer to the price was a little expensive but with premium quality. 

Rory splayed his hand and aimed the two barreled rifle at three dead sparrows near the hill, of kind of a C.S.I. spot when "the Dome" appears. The investigating guard had just faced the protested turnout and tried to stop him but the only Reverend seen with Lester's shirttail out and flying, then hi-impact slug struck the Dome dead on ricocheted, and what scurrying off into the high grass and made the splatters of blood on the hardwood. If only we had a high school midterm exam, I guess this could be sort of the "cloze test". Sort of, not sore of. See, saw, sore. Sort of. How you got to sharpen the saw when you are Under the Dome, or whatever, Under the Dorm of dormitory days? First to understand and then to be understood, and then? Not forgotten. What I remembered in those days was that kind of local quarrels sounded on campus in the dorm days. Therefore the dorm days under the dome was doomed to be flunked, wasn't it a good cloze test? The Pixie Light and Pixie Dark characters in Stephen King's previous novel Cell could not agree more, I think. Or maybe we could find that in a state local gazette, when we all know the reverend father struck a blow on the short figure. We are different not that you say it was difficult recently. We were not different since the salvation hero turned out on the street corner. My life became different since you came. Don't you agree with me upon this point?

Harry Potter and the Order of the Phoenix, novel reading

Harry Potter and the Order of the Phoenix, 2003 J.K. Rowling, Scholastic Inc.

What is the Order of the Phoenix? We can take an investigating look into J.K. Rowling's novel in the Chapter Five, "The Order of The Phoenix."
First is the words said by Sirius, "...at least you've been able to get out and about, stretch your legs, get into a few fights...I've been stuck inside for a month...There's not much I can do for the Order of the Phoenix."
-(A)---Obviously the Order is some kind of static activities which Sirius doesn't like.

Then is Harry asking Sirius, "how come he's in the order?"
"He's useful...also very loyal."
The third is Harry describing his status, "I asked Ron and Hermione but they said we're not allowed in the Order."
"And they're quite right," said Mrs. Weasley. "You're too young."
-(B)---Children and adolescents are receiving more respect in the west society. Sometimes they have suits and ties just like their adults' counterpart. They would be also addressed as "Sir", or "Junior".

"Since when did someone have to be in the Order of the Phoenix to ask questions?" asked Sirius.
"Harry's been trapped in that Muggle house for a month. He's got the right to know what's been happen..."
"You've too young, you're not in the Order," said Fred, "Harry's not even of age!"
"It's not my fault you haven't been told what the Order's doing," said Sirius calmly.
"He's not a member of the Order of the Phoenix!" said Mrs. Weasley.
"He's only fifteen and--"
"--and he's dealt with as much as most in the Order," said Sirius.
"Are you kidding?" said Bill incredulously.
"Dumbledore was the only one You-Know-Who was ever scared of!"
"Thanks to you, Dumbledore was able to recall the Order of the Phoenix about an hour after Voldemort returned," said Sirius.
"So what's the Order been doing?" said Harry.
-(C)---Knowledge is Power", as Francis Bacon said. When Bill asking to confirm that You-Know-Who was ever scared of the Headmaster Dumbledore, the learned scholar, the answer is that Dumbledore was able to recall the Order of the Phoenix about an hour after Voldemort returned.

"Working as hard as we can to make sure Voldemort can't carry out his plans," said Sirius.
"Tonks here, for one--she's too young to have been in the Order of the Phoenix last time."
"Didn't you see the Daily Prophet last week? They reported that he'd been voted out...and they're talking about talking away his Order of Merlin, First Class, too."
...she looked at Sirius, "You've given Harry plenty of information. Any more and you might just as well induct him into the Order straightaway."
"Why not?" said Harry quickly.
"I'll join, I want to join. I want to fight--"
"No"
It was not Mrs. Weasley who spoke this time, but Lupin.
"The Order is comprised only of overage wizards," he said.
"Wizards who have left school," he added.

The Hunger Games, novel reading

The Hunger Games, novel reading;

Katniss loves her sister Prim very much, even volunteers to be the tribute of District 12 to replace Prim because the twelve-year-old Prim is selected in the 74 Hunger Games as tribute. The sibling alike love also appears in Chapter 15 for another girl from District 11 called Rue, who spent quite a lot of time getting along with Katniss in the tree by the river, talking to mockingjay, chewing and spreading the herb on the injured calf of Katniss, a girl with Thresh from District 11. Rue in Chapter 18 is killed by a boy from District 1 by the spear. There are also some descriptions of the selecting of these young tributes:

“…You become eligible for the reaping the day you turn twelve.
That year, your name is entered once.
At thirteen, twice.
And so on and so on until you reach the age of eighteen,
the final year of eligibility,
when your name goes into the pool seven times…
So, at the age of twelve,
I had my name entered four times.
Once because I had to,
and three times for tessae for grain and oil for myself,
Prim and my mother…
So now, at the age of sixteen,
my name will be in the reaping twenty times.
Gale, who is eighteen and has been either helping or single-handedly feeding a family of five for seven years,
will have his name in forty-two times.”

The Hunger Games novel of Suzanne Collins, Book One, has 27 chapters, and in the Seventy-fourth Hunger Games, two victors from District 12, Katniss Everdeen and Peeta Mellark, in the Chapter 25 of the novel have already won the 74th hunger game. The remained two chapters, in the Chapter 26 it is dedicated to describe the Post Trauma Stress Disorder(PTSD) alike reaction of Katniss when she sees the doctors working on Peeta through the glass, and listens to the suggestion from Haymitch (about how to talk to the public or the press),
"Your only defense can be you were so madly in love you weren't responsible for your actions."

But we can see that Katniss is in doubt in her own conscious words that,
"I can't pull off the girl-driven-crazy-by-love scenario Haymitch has suggested."

That will be like caught between the Scylla and Charybdis a situation for Katniss to choose her own strategy.

The final chapter in Chapter 27 collects small details about daily life of the bread winners and lovers, also in words of Katniss that “dreading the moment when I will finally have to let go.”

Letter to McDonld's asking for help

Dear McDonald's Corporation:

I am a McDonald's customer in Taiwan. Several years ago before July 2004 I often drove my Toyota sedan to McDonald's "Drive-Through" service from McDonald's Wenhua Shop, located at the address No. 173 Section 2 Wenhua Road, Banquiao District, New Taipei City. New Taipei City was former Taipei Hsien(County). The Wenhua Shop McDonald's was owned by two partners, Mr Liao Cheng-han and Miss Chiu Shui-Chen, who were to some degree acquaintances to me. Ms Chiu Shui-Chen was my elementary school classmate in Taipei County Hope Elementary School. Both partners were dead in 2004 July and 2008, seemed undergoing some gangster rituals to be killed, Ms Chiu was suffocated and Mr Liao was excuted by gun shot. After their death the McDonald's revenue went to Chiu's daughter Ms Liao Yee-Wen, and Liao's son Mr Liao Jr. who seemed to grow up in Canada, ever studied in the City University of New York and had business degree from the New York University.

Recently I had a lawsuit from the Breeze Center owner of Liao Cheng-han's family, a libel case about a Yahoo! blog article which was related to the above criminal death case. The libel case was focused on whether Miss Liao Yee-wen was Mr Liao Cheng-han's daughter without legal  recognition. But the Breeze Center lawsuit delegate Mr Tsai and the district prosecutors and criminal police officers in several times refused to recognize the fact that the libel case privy Mr Liao Cheng-han was dead in the Banciao(Panchiao) community next to my house, and also denied the defense party, me, to used an item of evidence from the dead Miss Chiu Shui-chen's words by denying that Miss Chiu was dead, also in the very Banciao(Panchiao) community next to my house. The Wenhua Shop McDonald's revenue management seemd to be delegated to some MBA experts or company, last year had been conducting an investigation to the two dead partners and their relatives, to make sure the stamp of the owners could be used in a delegate contract renewal official document and resolving some local disputes related to charity donation. But it was said that their two daughter and son Miss Liao Yee-wen and Mr Liao Jr. did not legally transferred the ownership from their parents because the death of Mr Liao and Miss Chiu's death in the Banciao(Panchiao) community was denied by the government.

麥當勞文化店的收益人因麥當勞營收固定支付charity衍生糾紛或兩名合夥人死亡後以國家安全為理由未做法律登載，在2010年據悉信託財產管理公司到期續約，聘雇的企管公司因徵信而調查處理合夥人子女繼承問題、慈善捐款財務糾紛、與營收出納所需之業主印章問題，造成合夥人兩名子女的法律身份糾紛與父母刑事凶殺案與國安牽涉；板橋社區鄰居與麥當勞顧客張朝凱在2004年間常常駕駛豐田轎車到原台北縣議會對面該麥當勞文化店得來速(drive-through)購買速食用餐，據悉台北某檢察官在2011年8月前後以臉書蒐證邱淑貞女兒廖鈺玟後至台中住處查訪失敗後造成不滿，不到一年於2011聖誕節過後12月29日，新北市刑警以微風廖鎮漢提告妨害名譽為由，從家裏逮捕使用臉書剛滿一年，在這期間內將廖鈺玟的帳戶加為朋友的麥當勞的長期顧客張朝凱至新北市刑警隊偵訊，並於台灣板橋地方法院檢察署纏訟至今已屆滿四個月，檢察官與刑警硬是否認麥當勞板橋文化店合夥人在法律上於板橋社區先後死亡之事實，與合夥人邱淑貞、廖鎮漢的兩名子女或其微風廣場公司父執輩祖父等家長與親戚，因微風提告多起(約4件)相同案件曾有因妨害名譽案入監卻遭到法律身份死囚處決的糾紛；在板橋社區隔鄰有得知遭槍決之前案建國工專校友家長在年前法務部執行一波槍決後，從台灣南部趕來板橋社區，與社區住戶與管理委員會詢問兒子下落的相關對話內容。因之，您的決定是否幫助一個麥當勞長期顧客，對身為法律訴訟當事人可能為生死攸關的重要決定。

一、第 342 條 為他人處理事務，意圖為自己或第三人不法之利益，或損害本人之利益，而為違背其任務之行為，致生損害於本人之財產或其他利益者，處五年以下有期徒刑、拘役或科或併科一千元以下罰金。前項之未遂犯罰之。

二、被告劉東昀檢察官在1月30日台灣板橋地方法院檢察署偵查庭上，對於新北市刑警12月29日偵訊時含糊指稱提告人為微風廖鎮漢，但實質上年齡與身份明顯錯誤，在偵查庭上告訴人張朝凱意欲詢問廖鎮漢確實身份時，被告劉東昀檢察官蓄意以高姿態訊問告訴人張朝凱精神科與醫院往來記錄方式，規避告訴乃論案件最重要的告訴人確認提告人的行為，進行不公正的違背檢察官任務損害告訴人利益的行為，為刑法詐欺罪之第342條「為他人處理事務，意圖為自己或第三人不法之利益，或損害本人之利益，而違背其任務之行為，致生損害於本人之財產或其他利益者」，並在告訴人隨後當庭出言抗議時，又以朗誦新北市警局刑警隊筆錄並用強勢命令口吻進行詢問告訴人，是否願意撤下雅虎奇摩網頁與蔡明澤和解，接著並唐突的直接做法庭書記官記錄不願意和解內容，以偵查庭法律訊問流程掌控與檢察官權威，違背檢察官任務，拒絕告訴人在法律上平等詢問告訴乃論提告人廖鎮漢年齡身份明顯錯誤的任何機會；另外又在微風訴訟代理人蔡明澤因為美國聯邦調查局與警政署留存有廖鎮漢出席的2003.6湘廚餐廳錄影帶，在偵查庭上對廖鎮漢年齡身份不符合問題上無法自圓其說，因而撒謊廖鎮漢未參加婚禮甚至無該婚禮部份，面對告訴人在偵查庭上大動作表達與聲言微風代理人撒謊與欲進行詰問對質時，被告劉東昀檢察官竟然又大膽的以告訴人精神科就診事實已剛才詢問確認成證據的語氣，在偵查庭上刻意明顯以忽略告訴人的方式，關於刑事訴訟法第 181-1 條 被告以外之人於反詰問時，就主詰問所陳述有關被告本人之事項，不得拒絕證言。被告劉東昀檢察官於2012.1.30第304偵查庭上，這是第三次以損害告訴人利益，逕行拒絕了告訴人張朝凱詢問微風代理人蔡明澤關於告訴乃論提告人廖鎮漢年齡不符，與為何撒謊廖鎮漢未參加婚宴甚至無該婚宴的最關鍵證詞部份的機會，造成告訴人在偵查庭上詢問與證實自己在法律上清白的機會全遭不公正的剝奪；雖然印象中曾有同事或朋友無故在失業前的工作地點或其他公共場所詢問告訴人張朝凱，是否在家中清掃時把蔡旺儒高中同學的2003年6月湘廚餐廳喜帖丟掉或做資源回收了，答案簡單的說是丟了，回答更乾脆說那我就沒辦法幫你了，但是就蔡旺儒與邱鈴昭的2003年6月台北市南京東路的湘廚婚宴，除了可以當做證物被丟掉了的婚禮喜帖之外，告訴人仍有其他證物可證明微風代理人蔡明澤所說的謊言，證物是婚宴現場當天離席時和香煙、糖菓放在一起發給參加婚禮來賓的小型婚紗照片紀念品，敬請參閱附件的證物1：「蔡旺儒、邱鈴昭2003年6月湘廚餐廳婚宴婚紗照片」。在被告劉東昀檢察官如上述內容中多次以損害告訴人利益方式，不公正的拒絕告訴人詰問廖鎮漢的身份，在偵查庭進行時間與氣氛迫近結束的時刻，最後告訴人張朝凱緊急拿出備用的關鍵證詞小紙條，是抄寫2003年6月廖鎮漢在姪女邱鈴昭的湘廚婚宴親友席上，廖鎮漢朗聲告知婚宴現場聽眾包括親友與賓客的說話內容，要求被告劉東昀檢察官讓告訴人當庭朗讀關鍵證詞手上的小抄部份，取得被告劉東昀檢察官同意後，在朗讀到廖鎮漢當著親友說的關鍵證據部份「不承認邱淑貞，關於廖鈺玟呢？當然也不承認！」等等內容時，才不到幾分鐘的時間關鍵證據內容未唸完，又遭被告劉東昀檢察官擺個看起來像法庭要結束而不耐煩的表情並出言直接制止，當時是唸到關於廖鎮漢告知抱怨姪女邱鈴昭在紐約被聯邦調查局約談讓蔡旺儒知道而不喜歡的部份，被告劉東昀檢察官為了緩頰，接著親切的注視著告訴人張朝凱做偵查庭終了前說明，藉口說他會在回家後詳細閱讀告訴人在法庭呈上的辯護文件。

三、12月29日新北市刑警官於新北市刑警大隊偵訊室所提廖鎮漢告訴乃論的妨害名譽案訴訟標的網路文章，關於告訴人張朝凱之雅虎奇摩網頁內容中提到的關係人廖鎮漢與邱淑貞已經死亡的徵信部份，邱淑貞與廖鎮漢是麥當勞板橋文化店的合夥人，地址為新北市板橋文化路二段173號，在台灣之麥當勞板橋文化店兩名合夥人在數年之內因板橋社區幫派活動儀式導致連續死亡部份，告訴人張朝凱可憑自力經台灣板橋地方法院的寄信認證業務，寄往美國麥當勞總公司，請求麥當勞的美國總公司出面(參閱文件2)，是發出對麥當勞的兩名合夥人因先後遭遇軍事行動或幫派逼迫與處決殺害在板橋社區死亡一事進行徵信的請求。其中邱淑貞於2004年7月因窒息死亡，廖鎮漢約於2008年之後因槍擊心臟死亡，各遺留有一名子女廖鈺玟與美加歸國之小廖鎮漢。

在2004年7月命案現場有超過三名以上警察處理的後埔國小校友邱淑貞死亡案件，被告劉東昀法官在2012.1.30偵查庭上，連續對在2004年7月於板橋社區內已死亡的邱淑貞宣告為未死亡，造成告訴人張朝凱對微風妨害名譽刑案所提出個人法律上清白無罪，有重要關係的邱淑貞死前告知內容，被不公正的連續宣告成無效的證據，為違背檢察官任務，損害告訴人利益的詐欺行為。

四、在2012.1.30 台灣板橋地方法院304偵查庭上，被告劉東昀檢察官在檢座席上將手上揚起，檢查並展示宣讀微風代理人蔡明澤呈交加蓋廖鎮漢印章的訴訟委託書，因廖鎮漢於2008年之後已經死亡，不可能經過已經死亡的廖鎮漢經手的微風廖鎮漢妨害名譽告訴人委託書，事實上會構成刑法的偽造文書罪要件，而連帶被告劉東昀檢察官也會有共同的法律責任，也會有刑法詐欺罪第342條「或損害本人之利益，而為違背其任務之行為，致生損害於本人之財產或其他利益者。」的詐欺罪構成要件。

在2006年3月29日台灣台北地方法院簡易庭法官劉亭柏簡易庭裁決的匯豐銀行本票案，當時匯豐銀行香港商人通知劉亭柏法官為憲兵預官43期對銀行放款與存款客戶的告訴人有侵權行為要求前往指認作證未果，匯豐銀行應該是由李睿智更名為李匯豐先生的香港商人，在2006至2007年追蹤期間不久通知劉亭柏檢察官以詐騙死亡規避先前的法律違法追蹤，應為更名為劉東昀檢察官，當時對告訴人張朝凱的侵權是為現職檢察官至之板橋社區勘驗邱淑貞屍體，偽造文書告訴人名字張朝凱於驗屍相關文件，從劉亭柏法官進行簡易庭裁決，與2012.1.30台灣板橋地方法院偵察庭更名為劉東昀為同一人，同時詐欺死亡或在司法院以不同名字詐騙，也會有刑法詐欺罪第342條「為他人處理事務，意圖為自己或第三人不法之利益，或損害本人之利益，而為違背其任務之行為，致生損害於本人之財產或其他利益者。」的詐欺罪構成要件。

五、懇請 鈞署明鑑被告劉東昀刑事詐欺罪案，使告訴人張朝凱原本因1994.8.14美國依娃愛弗麗中士台北死亡案政治牽連，自2005年起在國家圖書館超過6年撰寫民權案件(參閱證物2, 雅虎奇摩網頁「邱淑貞2004死亡案」與「陳淑麗檢察官魔獸世界逃漏稅資料」之Dec 17, 2011筆記本草稿)，最後終能在自己國家政府的司法體系下，獲得法律上的公平正義下應得的一份。

Then US President George Bush who was a Yale alumni of Ivy League and a Republican politician as Governor Frank White, seeking ways to save the governor from prison, also solving the multiple identity issue presented publicly, granted to assist Bill and Hillary couples to elect into the White House.

President George Bush talked to his son Mr Bush Jr.(who seemed to be visiting friend at Taiwan), that Yale as well as Harvard were all Ivy League universities, shared the same brotherhood and university fund donation sources. Do not restrict in partisan issue to help a Democrat candidate to be elected. Mr Roger was wearing the same polo-shirt when seeing me from behind my library seat to the White House. After the Ford-truck nation-wide campaigns, the Bill and Hillary won the presidential election.

3f. 1991 June or April, Mrs Hillary Clinton came to Taipei City YWCA, ICRT(International Community Radio Taipei) music club, with a word said to me(David Chang, NCTU sophomore), saying not to use Chinese language in the gathering. She was previously coming to visit DPP(Democratic Progressive Party) Mr Chen Sui-bian, who told her that he could not meet her because he was no longer a local city council member but a "central" legislator. Mrs Hillary then was seeking to visit the KMT(Kuomintang) officials which were also rejected her because they were sided with the Republican presidential candidate. It was notified that this was a lose-face for the USA, because the Ivy League alumni was rejected by Taiwan. No sooner had Mrs Hillary Clinton returned to the US(White House aide job) than Bill was announced elected to the White House.

The one-reeler Saved From the Titanic, made by Éclair American Co. at its super-modern, glass-covered Fort Lee studio in New Jersey, was released 29 days after the liner sank and took 1,517 lives with it. In one respect at least, the 10-minute movie will never be bettered for authenticity, since its main attraction, the heavy-lidded, cushion-lipped, 22-year-old Dorothy Gibson-star of Revenge of the Silk Masks and It Pays to Be Kind, and cover girl of countless magazines--was a survivor from Lifeboat 7. Starting work a few days after landing back in New York off the rescue ship RMS Carpathia, Dorothy had only to play herself, which she apparently did with frightening aplomb...And you thought Kate Winslet was interesting? Silly you...

意見內容：	敬愛的司法院長賴浩敏先生： 1.2012年4月2日下午2:10, 台灣板橋地方法院檢察署第305偵查庭，黃股101年偵字第2752號妨害名譽案，被告張朝凱於偵查庭以朗誦法律條文： 刑事訴訟法第181-1條 被告以外之人於反詰問時，就主詰問所陳述有關被告本人之事項，不得拒絕證言。 4月2日14:10第305偵查庭檢察官回答以「案件尚未起訴」為理由，拒絕被告張朝凱提出要求就微風廖鎮漢代理人蔡明澤，偵查庭上撒謊「廖鎮漢未參加姪女邱鈴昭與蔡旺儒2003.6歸寧婚宴，甚至根本沒有該婚禮」證詞部份作說明，明顯違反刑事訴訟法條文。 2.附錄4月2日第305偵查庭相關摘要記述於本司法信箱電子文件之後。 敬祝 時祈 新北市板橋區民眾 張朝凱 F121485303, SSN057864042, April 5, 2012, New Taipei City Library, Panchiao, New Taipei City 台灣板橋地方法院檢察署刑事偵查庭 (新北市刑警大隊與微風廖鎮漢告訴，2012.4.2第2次偵查庭) 案號案由：黃股　101年度偵字第2752號 妨害名譽 案件 2012年4月2日，土城區青雲路..第305偵查庭‧--‧--‧檢察官, 書記官， 被告張朝凱，告訴人微風廖鎮漢代理人蔡明澤 PM 02:10報到, PM 02:10開庭至PM 03:10檢察官以書面列印網路誣告書狀質問，被告回答稍後自行於檢察署告訴後離庭； 2012.4.2第305偵查庭言詞詰問： 1. 告訴之微風廖鎮漢代理人蔡明澤，當庭告知廖鎮漢為60年次，非54或56年次。305偵查室庭上檢察官告知邱淑貞為57年次。 庭上檢察官告知1月30日前次偵查庭所提之蔡旺儒，「人在國外不能到庭」，並詢問被告與告訴代理人雙方對此有無意見。微風廖鎮漢代理人蔡明澤回答無意見；被告張朝凱回答「蔡旺儒是庭上檢察官找的，不是我要求找來偵查庭的，與我無關。」 2.被告另外解釋告知庭上檢察官，美國ＦＢＩ聯邦調查局對台灣刑事案件並無偵查與調查職權，（與邱鈴昭結婚購置）板橋社區住戶蔡旺儒於２００４年７月１５日後交付美國聯邦調查局的物證錄影帶，是透過當時的台北縣警察局或是警政署會同調查而交付調查的，為警方經手稱為實質證物evidence的法律有效證據內容。 3.庭上檢察官告知要求就影印的數份廖鈺玟的相片資料要求挑選指認，在被告挑出樣貌較相近者時，庭上檢察官詢問是否認識廖鈺玟，並詢問中文的姓告要怎麼寫，被告時間已隔10年並非記憶十分清楚，但是當時在湘廚詢問時廖鈺玟說明王文玟時與被告分手的前女友呂向雯的名字有音同加以詢問者，然後庭上檢察官告知經查該女生僅有8歲年齡不符合怎麼會是你所稱述者，被告立即反駁告知那是挑出樣貌相似者，既然庭上檢察官說年齡8歲不是，當然非廖鈺玟。在1998年春節大年初一或初二在高雄大世界國際村與邱淑貞於檳榔攤的廖鈺玟，當時12歲，被告29歲；在2003年6月湘廚婚宴上，廖鈺玟17歲，被告33歲；在婚宴上當時廖鈺玟已經考完大學甄試，可以甄試申請上大學。 4.庭上檢察官話鋒一轉，又告知邱淑貞57年次，你是60年次，怎麼會是你的同學；被告突然想起小學一年級有寄讀數年稍做說明，但隨即停止尚未確定的邱淑貞年齡訊問內容之回答，告知庭上檢察官在1998年高雄大世界國際村檳榔攤與後來的告知內容，「是邱淑貞主動向我說明，確認她的確是我的小學同學。」當時邱淑貞還提到家長在忠孝路口的水果攤賣橘子的某某女同學，「還記得嗎？是我們的同班同學。(兩人共同的同學)」，為小學同學reference關係人提供，被告告知小學畢業紀念冊上應該可以找得到。庭上檢察官進一步逼問並要求提供小學畢業紀念冊資料，被告當場拒絕，告知微風廖鎮漢與委託人提告的妨害名譽案件範圍，是僅限於雅虎奇摩個人網頁上被告撰寫邱淑貞死亡刑案內容中，提到的廖鎮漢與廖鈺玟以及邱淑貞死亡前告知的證詞部份，不應該越扯越遠。 5.另外被告就庭上檢察官列印數份有相片的黑白身份資料指認廖鈺玟並告知被告指認錯誤部份，被告另外告知就湘廚婚宴上與廖鈺玟的聊天內容，廖鈺玟告知小學在台北市圓山地區，孔廟與大龍峒的附近的那間小學與國中唸書的(未在偵查庭上提出明倫國中的確切字樣)。 5a.被告當庭告知在2003.6湘廚婚宴上聊天時，當時17歲的廖鈺玟曾告知其母親邱淑貞是被告的同學，並且告知她與母親邱淑貞先前和被告「我們有見過面啊。」 6.被告當庭告知撰寫Yahoo!雅虎奇摩個人網頁文件，原因是為了隔壁社區發生的邱淑貞的死亡刑案，因為在2004.8.2板橋社區內住戶被告的親戚表妹翁淑芬有購屋與前醫生或憲兵特勤隊的男友居住，當時要求其男友從後門跑至隔鄰被告的住家樓下按電鈴，要求被告前往社區內「協助(警察)處理刑案」，當時被告回答「你不是說有警察在調查，為什麼需要我前往社區內協助處理？」社區承建商住戶尾隨在憲兵特勤隊員之後從社區後門跑出忠孝路馬路上，並告知當時應是認為被告為不熟悉的鄰居的場面話語：「社區內已經有他(憲兵特勤隊員)的親戚去和警察處理了！(你不要理那個特勤憲兵亂說話)。」 但是該板橋社區內2004.7.15左右發生的「刑案」，因特勤憲兵隊員跑來住家按電鈴，並稱謂被告「排長」，要求被告前往社區內「協助警察處理」，該「刑案」從2004年8月2日開始與被告發生牽涉的事端。 6a.當庭綜合告知撰寫邱淑貞死亡刑案網路文件，是因為上述6.所提死亡刑案原因，並非意圖對微風廖鎮漢進行妨害名譽進行侵權而發生的行為。 7.微風廖鎮漢代理人蔡明澤於4月2日第305偵查庭上堅稱廖鎮漢「據我所知，是60年次」，微風廖鎮漢的委託代理人對2003.6台北市南京東路二段206號梅子餐廳與湘廚婚禮，仍堅稱廖鎮漢未參加，不願認錯，並告知若被告不撤下Yahoo!雅虎奇摩網路文章，會繼續對被告提訟。 7a.被告當庭對台灣板橋地方法院4月2日305偵查庭檢察官與代理人蔡明澤朗誦告知刑訴法條文：刑事訴訟法第181-1條 被告以外之人於反詰問時，就主詰問所陳述有關被告本人之事項，不得拒絕證言。 被告張朝凱在朗誦法條後，並向305偵查庭上檢察官要求對微風廖鎮漢代理人蔡明澤，就1月30日與4月2日當日偵查庭代理人撒謊廖鎮漢未參加婚禮進行說明；305偵查庭上檢察官竟然以回答「偵查庭案件尚未起訴」，拒絕被告以刑事訴訟法條文提出要求代理人說明證詞撒謊部份。按照刑事訴訟法條文內容，第1條 犯罪，非依本法或其他法律所定之訴訟程序，不得追訴、處罰。 台灣板橋地方法院4月2日第305偵查庭與檢察官可能有違反刑事訴訟程序，造成法律上的錯誤或失效。 8.被告在4月2日告知第305偵查庭上檢察官，對於邱淑貞死亡刑事案件，新北市刑警大隊與台灣板橋地方法院偵查庭檢察官，對台北縣警局或警政署會同美國聯邦調查局FBI共同查案，有婚禮餐廳錄影帶證物提供部份內容，數次在法律上說明與宣告邱淑貞未死亡與廖鎮漢未參加婚禮，因而造成法律在假設前提上的重大基本錯誤，因而案件後續在邏輯推理上必然會造成與法律上的事實互相衝突的矛盾錯誤，造成被告認知為案件無法繼續進行。被告最後以強烈語氣當庭告知：「另外，庭上(地方法院地檢署)這樣是違法的！」 9.在被告以法律條文輔助強烈提出抗議後，庭上檢察官告知「我並沒有說邱淑貞未死」等等，最後拿出被告意欲進行告訴的誣告網路列印文件，告知被告是否需要處理等等，被告回答「我等一下自行提告」，在305偵查庭文件上雙方簽名結束4月2日偵查過程。被告隨後離開地檢偵查大樓並於法庭大樓文件收發處，將「劉東昀檢察官瀆職 告訴狀」與「新北市政府警察局刑警大隊與微風廖鎮漢妨害名譽 誣告案」兩份告訴文件，分別訂上附件「1月30日偵查庭妨害名譽辯護書」，簽名蓋章後，完成兩件案件地檢署告訴的程序，收發書記官蓋了收發章後告知等候寄傳票通知。 10.在4月2日的台灣板橋地方法院第305偵查庭，庭上檢察官提到「邱淑貞為57年次，(被告)你為60年次，為什麼她會是你的同學？」時，被告重覆在2012.1.30第304偵查庭對(劉東昀)檢察官告知的內容，「邱淑貞與邱鈴昭的媽媽邱淑真為攣生姊妹，姓名發音相同，但是中文書寫的字不一樣。」被告張朝凱當時有注意到在1.30的偵查庭(劉東昀)檢察官有些亢奮，但是聲音較低，音量較宏亮，並且十分高興的詢問：「邱淑貞真的是你的小學同學？」，然而4.2第305偵查庭此次坐著的檢察官在做類似相同的敘述說明時，聲音較細，音量較小，對我以詢問式開頭的回答內容：「我在上次1月30日偵查庭上(不是有)告知邱淑貞的孿生姊妹...」庭上檢察官看起來好像沒有任何反應，像是沒印象或是忘記了的模樣，但是約一個小時的偵查庭過程，我並沒注意外頭第305偵訊室schedule與名牌上的檢察官名字是否有不同，但是我有注意到書記官兼法警換了另一人，後來在檢查署文件收發處提告劉東昀檢察官瀆職告訴與新北市刑警大隊與微風廖鎮漢誣告之告訴後，在法院大門口金城路，發現原先1月30日第304偵查庭的書記官兼法警，身著法警制服在大門口站崗與指揮交通。 ----------------------------------------------------------- (A)廖鎮漢姪女邱鈴昭2003.6婚宴拍攝的家庭錄影帶可能並無涵蓋案件內容所有的關鍵證人，另外還有湘廚婚宴餐廳的內部監視錄影帶證物來源，可能牽涉祕密證人或是業務機密，為板橋社區住戶2004.7提供台灣警方會同轉交美國聯邦調查局查案之外的證物來源。
